Terms of Service

1. Acceptance of Terms

By accessing or using Mariner's Log ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including recreational boaters, commercial operators, and charter captains.

2. Description of Service

Mariner’s Log is an AI-powered digital captain’s log application designed to help mariners document their voyages through voice-first technology. The Service provides voice recording, AI transcription, location capture, weather capture, and log management features. Paid subscription plans for the Service are described on our pricing page and governed by Section 4 below.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Not share your account with others

4. Subscriptions, Free Trial and Billing

4.1 Plans

The Service is offered on paid subscription plans. Current plans, prices, included allowances and billing intervals are shown on our pricing page, which forms part of these Terms. Prices are stated in US dollars and exclude any sales, use, VAT or similar taxes, which will be added where we are required to collect them.

Where no paid plan is currently offered, the Service is provided to you free of charge and the rest of this section does not apply to you until you choose to start a subscription. We will not begin charging an existing account without telling you first and asking you to choose a plan.

4.2 Free trial

New accounts may start a free trial of the length stated at checkout. A valid payment method is required to begin a trial. Unless you cancel before the trial ends, your subscription begins automatically at the end of the trial and the payment method you provided will be charged the plan price shown at checkout. You may cancel at any point during the trial at no cost, from the Billing page in your account. One trial per person or vessel operator; we may decline a trial to an account that has already used one.

4.3 Automatic renewal

Subscriptions renew automatically at the end of each billing period, monthly or annual as selected, and your payment method will be charged the then-current price for your plan until you cancel. The renewal date and the amount are shown on the Billing page in your account at all times.

4.4 Payment processing

Payments are processed by Stripe, Inc. You authorise us and Stripe to charge your payment method for all amounts due. We do not receive or store your full card number, expiry date or security code. Your use of Stripe is additionally subject to Stripe’s own terms. You are responsible for keeping your payment details current.

4.5 Failed payments

If a payment fails, we and Stripe may retry the charge. We may suspend or downgrade access to paid features while an amount remains unpaid, and may terminate the subscription if it is not resolved. Your existing logs remain available for export during any such suspension.

4.6 Price changes

We may change subscription prices. We will give you at least 30 days notice by email before a change takes effect for your subscription, and the change will apply from your next billing period. If you do not accept the new price, you may cancel before it takes effect.

4.7 Included allowances

Plans may include a monthly allowance of AI First Mate voice time or other metered features, as stated on the pricing page. Allowances reset at the start of each billing period and do not carry over. If you reach an allowance, the rest of the Service continues to work and you may upgrade at any time. We will not charge you more than your plan price without your express agreement.

5. Cancellation and Refunds

You may cancel your subscription at any time from the Billing page in your account, which opens our payment provider’s secure portal. Cancellation takes effect at the end of the billing period you have already paid for: you keep full access until that date and you are not billed again. No cancellation fee applies and you do not need to contact us to cancel.

Payments are non-refundable. We do not provide refunds or credits for partial billing periods, for periods in which the Service was not used, or for downgrades. This does not affect any right to a refund you may have under the law of your country that cannot be waived by agreement, and it does not limit our obligations where we have charged you in error.

You can export your logs to PDF at any time, before or after cancelling.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload malicious code or harmful content
• Impersonate another person or entity
• Use the Service to transmit spam or unsolicited communications
• Reverse engineer or decompile any part of the Service

7. Content Ownership

You retain ownership of all content you create using the Service, including log entries, recordings, and notes. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your logs or personal data.

8. Maritime Compliance Disclaimer

While Mariner's Log is designed to ask and collect maritime documentation including USCG Official Logbook Requirements (46 USC 11301) and 46 CFR 131.620 (Matters that must be logged), it is provided as a supplementary tool. The Service does not replace official logbooks required by the U.S. Coast Guard, Transport Canada, or other maritime authorities. Users are solely responsible for ensuring compliance with all applicable maritime regulations, including maintaining required paper or official electronic logs where mandated by law. The Mariner is required to review the output for accuracy and completeness.

Data Collected in Commercial Mode

When operating in Commercial mode, Mariner's Log AI assistant prompts for and collects the following information in accordance with USCG requirements:

9. AI-Generated Content

The Service uses artificial intelligence to transcribe voice recordings and generate log summaries. While we strive for accuracy, AI-generated content may contain errors. You are responsible for reviewing and verifying all transcriptions and summaries before relying on them for official purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARINER'S LOG AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

We are not liable for any damages arising from: equipment failure at sea, loss of data, inaccurate GPS or weather information, reliance on AI transcriptions, or failure to maintain compliance with maritime regulations.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

12. Indemnification

You agree to indemnify and hold harmless Mariner's Log, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may export your data before termination using our export features.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Hawaii, without regard to conflict of law provisions.
